It is also against the law to retaliate against an employee for opposing discrimination or harassment, filing a complaint of discrimination or harassment or helping another employee file a complaint of discrimination or harassment.

Did You Know?

Generally, both federal and state laws prohibit employment discrimination only where the employer has 15 or more employees. For example, an employee who believes he or she is the victim of age discrimination may not be covered by the laws if he or she works for a company with fewer than 15 employees. There are exceptions, however.

However, employers with just one or more employee may be held liable under Illinois state law for complaints of sexual harassment or disability discrimination.

Signs of Discrimination or Harassment

Discrimination means that you were treated differently than other employees because you have one or more of the characteristics listed above. For example, if you are more than 40 years old and you are fired after being late to work three times - but an employee under 40 years old was just given a warning - that may be age discrimination.

Sexual harassment means unwelcome conduct of a sexual nature when the employee's acceptance or rejection of the conduct is used as a basis for employment decisions or when the sexual conduct disturbs the employee's job performance or creates a working environment that is intimidating, hostile or offensive.

Racial harassment means name-calling or negative comments based on race, color, national origin, ancestry or citizenship status.
